This Privacy Policy explains how Limitless Migration Services Pty Ltd (Limitless, we, us or our) collects, holds, uses and discloses personal information when you visit our website, complete an online assessment, contact us, request a consultation, or engage us for Australian migration services.

This policy should be read with any engagement letter, written service agreement, online assessment terms and conditions, and other notices we give you at or before collecting your information.
2. The privacy framework we follow
We aim to handle personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles where they apply, and the confidentiality and recordkeeping obligations that apply to registered migration agents.
Some small businesses may not be covered by every obligation in the Privacy Act. However, because migration work commonly involves identity documents, visa information and sensitive information, we aim to apply privacy protections consistent with the Australian Privacy Principles to all clients and enquiries.
3. What information we collect
Depending on the service or enquiry, we may collect:
- your name, date of birth, contact details, residential address and preferred language;
- passport, identity, citizenship, visa and immigration history details;
- information about family members, relationships, dependants and sponsors;
- employment, education, qualifications, skills, professional registration and travel history;
- health, disability, biometric, police, criminal-history and other sensitive information where it is relevant to a migration matter;
- documents and information supplied by you or by a person you authorise to act for you;
- information about payments, invoices, refunds and disbursements;
- records of telephone calls, meetings, emails, online forms and other communications;
- information needed to manage complaints, professional obligations, insurance or legal matters; and
- technical and usage information such as IP address, browser, device, approximate location, cookies and website activity where these tools are enabled.
We only seek information that is reasonably necessary for the relevant purpose. We will generally ask for your consent before collecting sensitive information where consent is required by law.
4. How we collect information
We may collect information:
- directly from you through our website, online assessment, enquiry form, email, telephone, appointment, portal or other communication;
- from documents you provide or authorise us to obtain;
- from a person you authorise, such as a family member, sponsor, employer, nominated person, interpreter or another professional adviser;
- from government departments, tribunals, review authorities, skills assessing bodies, medical providers, police or other relevant organisations where authorised or permitted;
- from service providers supporting your matter; and
- from publicly available sources where lawful and reasonably necessary.
If you do not provide information we reasonably need, we may be unable to assess your circumstances, provide a service, communicate with you, or progress your matter.
5. Online assessments and initial enquiries
Our online assessment is intended to collect information for a preliminary assessment and to help us respond to your enquiry. It is not, by itself, a visa application, a visa decision, a guarantee of eligibility or a guarantee that a visa will be granted.
Submitting an online assessment does not automatically create a client-agent relationship or authorise ongoing immigration assistance. Where immigration assistance is to be provided, we will ordinarily require a written service agreement before providing that assistance, except where a limited initial consultation exception applies.
Information provided in an online assessment may be retained as an enquiry record. If the assessment becomes part of a client matter, it may form part of the client file and be retained in accordance with our professional recordkeeping obligations.
6. Why we use personal information
We may use personal information to:
- respond to enquiries and provide preliminary information;
- assess migration, visa or citizenship options at your request;
- provide consultations and immigration assistance under a written service agreement;
- prepare, submit and manage applications, submissions and related correspondence;
- verify identity, documents and instructions;
- communicate with you, your authorised representatives and relevant third parties;
- arrange translations, medical examinations, police checks, skills assessments or other services;
- issue invoices, process payments, manage refunds and account for disbursements;
- maintain client files, records of communications and other records required by law or professional obligations;
- comply with the Migration Act 1958 (Cth), the registered migration agent Code of Conduct, court or tribunal processes, lawful requests and other legal obligations;
- manage complaints, audits, professional indemnity insurance, legal claims and risk;
- operate, secure and improve our website, systems and online services; and
- send information about our services where permitted by law and, where required, with your consent.
7. Who we may disclose information to
We may disclose relevant personal information, with your authority or where permitted or required by law, to:
- the Department of Home Affairs and other Commonwealth, state or territory authorities;
- tribunals, courts, review bodies and regulatory or professional authorities, including the Office of the Migration Agents Registration Authority;
- employers, sponsors, nominators, family members or other persons involved in your matter where you authorise the disclosure or it is necessary for the service;
- skills assessing bodies, education providers, medical practitioners, panel physicians, police authorities, translators, interpreters and document or identity-verification providers;
- our information technology, cloud storage, email, customer relationship management, online assessment, portal, payment, accounting, insurance, legal and professional service providers;
- contractors or other service providers who need the information to perform services for us and who are required to handle it confidentially; and
- government, law-enforcement or other bodies where disclosure is required or authorised by law.
We aim to disclose only information that is relevant and reasonably necessary for the purpose. We do not sell personal information.
8. Overseas disclosure and service providers
Some providers we use may store or process information in Australia or overseas. Provider locations, terms and data-handling practices can change, so we will keep this information under review and provide current details where required:
- Email and business systems: Microsoft; storage and processing locations may vary by service and account configuration
- Migration management or online assessment platform: Migration Manager; storage and processing locations may vary by service configuration
- Cloud storage and backups: Microsoft OneDrive; storage and processing locations may vary by service and account configuration
- Payment processing: payment providers used for client transactions; payment data handling depends on the provider and service used
- Website hosting: Hostinger, which may store website data outside Australia as described in Hostinger's privacy policy
Where information is disclosed overseas, we take reasonable steps to select reputable providers and to require appropriate privacy and security protections. Overseas recipients may also be subject to the laws of the countries where they operate.
9. Confidentiality and protection of information
We treat client information as confidential. We will not disclose personal information about a client or former client to a third party without written authority unless disclosure is required or authorised by law, is necessary to provide an authorised service, or is otherwise permitted by this policy and applicable law.
We take reasonable administrative, technical and physical steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Depending on the circumstances, safeguards may include access controls, account authentication, secure transmission, restricted file access, confidentiality obligations, backups, monitoring and secure disposal.
No internet transmission or storage system can be guaranteed to be completely secure. Please tell us promptly if you suspect that an account, email or document sent to us has been compromised.
10. Keeping and destroying information
We keep information only for as long as reasonably necessary for the purpose for which it was collected, to provide services, resolve disputes, satisfy legal and professional obligations, and protect our legitimate interests.
Client files and records may be kept electronically. Where the Code of Conduct applies, we generally retain client files for at least seven years after the last action on the matter. Some records may need to be retained longer because of a legal, insurance, complaint or regulatory requirement.
When information is no longer required, we take reasonable steps to securely destroy it or de-identify it, subject to lawful retention requirements. Enquiry and online assessment records that do not become a client matter are retained only for as long as reasonably necessary for the enquiry and any applicable legal or professional obligations; the actual period depends on the nature of the enquiry.
11. Access and correction
You may request access to personal information we hold about you and ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading.
Requests should be sent to admin@limitlessmigration.com.au with enough information for us to identify you and locate the relevant records. We may need to verify your identity and may be unable to provide information where an exception applies under law, including where disclosure would unreasonably affect another person's privacy or prejudice a legal or regulatory process.
We aim to respond to access and correction requests within 30 days where practicable. We will not charge you for making a correction request. A reasonable charge may apply for providing access where permitted by law, and we will explain any charge before proceeding.
If you ask in writing for documents to be returned, documents to which you are entitled will generally be returned in accordance with the applicable professional requirements.
12. Data breaches
If we become aware of a suspected or confirmed data breach, we will take reasonable steps to contain, investigate and remediate it. Where a breach is an eligible data breach under the Notifiable Data Breaches scheme, we will notify affected individuals and the Office of the Australian Information Commissioner as required by law.
14. Direct marketing
We may send service updates, educational information or marketing communications where permitted by law. You can unsubscribe using the link in the message or by contacting us at admin@limitlessmigration.com.au.
Unsubscribing from marketing will not stop important service, legal, billing or security communications about an existing enquiry or matter.
15. Children and information about other people
If you provide information about a child or another person, you confirm that you are authorised to provide it and to consent to its use where consent is required. We will collect and use information about children only where reasonably necessary for the relevant migration or service purpose.
